SDLT must be filed and paid within 14 days of the effective date of the land transaction (usually completion). Missing this deadline triggers: immediate £100 penalty, further penalties at 3 and 12 months, and interest at 7.75% p.a. from day 15. The conveyancing solicitor normally handles the SDLT filing, but the client must ensure funds are available.
Non-resident SDLT reclaim opportunity
Non-UK residents pay a 2% SDLT surcharge on UK residential property purchases. If the buyer subsequently becomes UK resident (spending 183+ days in the UK in any 12-month period within 2 years of purchase), they can reclaim the 2% surcharge. The refund can take several months to process. An SDLT bridge funded the surcharge; the reclaim repays the bridge.
Additional dwelling surcharge - recent changes
The additional dwelling SDLT surcharge (for BTL and second homes) was increased from 3% to 5% from 31 October 2024. This significantly increased SDLT costs for landlords and investors.
